Terms of Service

Welcome to SafeDealz ("**Platform**"). By creating an account or using the **SafeDealz App** ("**App**"), you ("**User**") agree to be bound by these Terms of Service ("**Terms**").

These Terms form a legally binding agreement between you and the operator of the SafeDealz platform. If you do not agree to these Terms, do not use the App.

1. Definitions

  • "Device": Any used mobile phone or electronic device listed, quoted, or traded through the Platform.
  • "Store Partner": A retail store staff member connected to you through the Platform who captures and submits device information.
  • "Quote": A device valuation generated by the Platform based on condition data submitted by a Store Partner.
  • "Verifiable Data Package" (VDP): The set of images, diagnostic results, and device information (including IMEI) captured through the App. The VDP is the sole basis on which quotes are issued and transactions are agreed.
  • "Transaction": A completed agreement between you and a Store Partner to exchange a Device at a quoted price.

2. Account Registration

2.1. You must provide accurate information when registering. You are responsible for maintaining the confidentiality of your login credentials.

2.2. You must be at least 18 years old and legally capable of entering into a binding contract to use the Platform.

2.3. One account per person or business. Creating multiple accounts to circumvent suspensions or restrictions is prohibited.

3. Quotes and Transactions

3.1. Quotes are based on the VDP. Every Quote issued through the App is based solely on the VDP submitted by the Store Partner. You acknowledge that the physical device at the time of pickup must match the VDP.

3.2. Accepting a Quote. When you accept a Quote, you enter into a binding agreement to purchase the Device at the stated price, subject to the Device matching its VDP at pickup.

3.3. Reliance on the VDP. SafeDealz does not independently verify devices. The Store Partner is responsible for accurately capturing the device condition. SafeDealz's role is to facilitate the transaction — not to warrant the physical device.

4. Disputes and Discrepancies

4.1. Valid Dispute. The only valid basis for disputing a transaction at pickup is a Material Discrepancy — where the physical device's make, model, or condition is demonstrably different from its VDP.

  • Process: Disputes must be raised through the App before leaving the store. Disputes raised after the fact will not be considered.
  • Resolution: SafeDealz will review the VDP against your evidence. If a Material Discrepancy is confirmed, the transaction will be cancelled at no cost to you.

4.2. Invalid Disputes. Refusing to complete a transaction for reasons other than a Material Discrepancy (e.g., change of mind, market price movement) constitutes a breach of these Terms and may result in account suspension.

5. Prohibited Conduct

You agree that you will not:

  • Use information obtained through the Platform to contact Store Partners directly to conduct transactions outside the Platform ("side deals").
  • Collude with Store Partners to manipulate prices, bypass the Platform, or circumvent SafeDealz's role in the transaction.
  • Submit false, misleading, or fraudulent information.
  • Use the App for any unlawful purpose, including the trade of stolen or blacklisted devices.
  • Attempt to reverse-engineer, scrape, or otherwise misuse the Platform.

Violation of any of the above may result in immediate, permanent termination of your account.

6. Limitation of Liability

6.1. SafeDealz is a facilitating platform. We are not a party to the underlying transaction between you and the Store Partner, and we do not take ownership of any device at any point.

6.2. To the maximum extent permitted by applicable law, SafeDealz's total liability to you for any claim arising from a single transaction is limited to the amount of any platform fee paid in connection with that transaction.

6.3. SafeDealz is not liable for losses arising from market price fluctuations, device condition disputes not raised through the proper process, or downtime of the Platform.

7. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

8. Governing Law

These Terms are governed by the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in India.
